MON APRIL 20 2026-theGBJournal| The Federal High Court in Abuja has dismissed a suit filed by Air Peace Limited, affirming the authority of the Federal Competition and Consumer Protection Commission (FCCPC) to investigate consumer complaints and issue summons in line with its statutory mandate.

In a judgment delivered on Monday, April 20, 2026, Justice James Omotosho upheld the Commission’s powers under the Federal Competition and Consumer Protection Act (FCCPA) 2018, reinforcing its role in receiving complaints, assessing cases, and taking appropriate lawful steps, including investigations where necessary.

Reacting to the ruling, FCCPC Executive Vice Chairman and CEO, Tunji Bello, described the decision as a significant clarification of the Commission’s oversight role in safeguarding consumer rights and ensuring fair market practices.

He noted that the case stemmed from complaints over unrefunded ticket fares, flight cancellations, and other service-related issues affecting passengers.

Bello reiterated that consumers who pay for services are entitled to transparency, fair treatment, and timely redress, stressing that investigations by the Commission are administrative processes aimed at establishing facts and do not imply guilt or liability.

He added that the FCCPC remains committed to engaging businesses in a fair and transparent manner while upholding due process, urging businesses operating in Nigeria to cooperate with lawful regulatory processes and to maintain effective complaint resolution systems that address consumer issues promptly and fairly.

The Commission, he said, will continue to enforce its mandate to protect consumers, promote competition, and build confidence across critical sectors, including aviation.

The FCCPC, he said, will continue to act within its statutory mandate to protect consumers, promote competitive markets, and strengthen confidence in essential service sectors, including aviation.

The Federal Competition and Consumer Protection Commission is Nigeria’s primary competition and consumer protection authority established under the Federal Competition and Consumer Protection Act, 2018.
