The court of appeal has dismissed an application for stay of proceedings in a matter brought against him at the Federal High Court over receipt of N400million, filed by Olisah Metuh, spokesperson of the Peoples Democratic Party (PDP).A three man panel led by Justice Abdul Aboki in its ruling said that the appeal court lacks the power to stay proceedings at the lower court, that the court will not issue an order to the Federal High Court to stay proceedings in the ongoing trial of Metuh.
Justice Aboki said that it was wrong on the part of the appellant to have made such an application before the appeal court. “Bear in mind that the court will not entertain any application for stay of proceedings,” he said.
The court had earlier adjourned hearing on a similar application brought by leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, to May 5, 2016 for hearing.
