THUR, JAN 25 2024-theGBJournal|The Supreme Court in Abuja on Thursday affirmed the election of Siminalayi Fubara as Governor of Rivers State, dismissing the challenge brought by the All Progressives Congress (APC) candidate in the Rivers State governorship election, Tonye Cole on the grounds that it lacked merit.
Tonye Cole was seeking the nullification of the victory of Governor Fubara of the Peoples Democratic Party (PDP) in the March 18, 2023 Governorship election on the grounds that the outcome did not reflect compliance with the Electoral Act among others.
He earlier had lost his challenge at the Appeal Court.
At the Supreme Court, Cole sought the reversal of the judgements of the Court of Appeal and the Tribunal, which upheld the declaration of Fubara as the winner of the Rivers Governorship Election.
A five member panel of justices led by Justice Kudirat Kekere-Ekun, who is absent in the court today, again dismissed Cole’s wishes as lacking in merit.
The judgement was read by Justice Mohammad Saulawa. The Court ruled that the Cole did not prove the allegations of non compliance with the Electoral Act among others.
