Reps passes amendment to Electoral Act 2026, propose N10 million fine or two-year jail term for dual party membership

WED MAR 11 2026-theGBJournal| Nigeria’s House of Representatives has passed amendments to the Electoral Act 2026, introducing stricter penalties aimed at curbing political opportunism and strengthening party discipline ahead of future elections.

Among the key provisions is the introduction of three new subsections to section 77 of the Act, which deals with political party membership.

It says that any individual found holding membership in more than one political party should face a fine or a two-year prison sentence.

”Where it is established that a person is registered as a member of more than one political party at the same time, such dual membership shall be void, and the person shall cease to be recognised as a valid member of any political party pending regularization in accordance with the provisions of this Act and the constitution of the political party concerned.

A person who knowingly registers or maintains membership in more than one political party at the same time commits an offence is liable on conviction to a fine of
N10,000,000 or to imprisonment for a term of two years, or both.”

Analysts say that by criminalising dual party membership, the House hopes to reinforce transparency within the political system and ensure clearer party allegiance among candidates and political actors.

The proposed amendment also forms part of broader efforts by the National Assembly to improve the credibility of Nigeria’s electoral framework following controversies that have trailed party primaries and defections in recent election cycles.

Legislators argued that stronger legal consequences are necessary to deter practices that undermine internal party democracy.

If signed into law, the new provisions are expected to reshape political party conduct and tighten compliance with electoral regulations as the country gradually prepares for the 2027 general elections.
