FRI. 03 MARCH 2023-theGBJournal | Labour Party (LP) presidential candidate in the February 25 general election, Mr Peter Obi, has filed a suit at the Presidential Election Petition Tribunal, Abuja, challenging the declaration of Bola Ahmed Tinubu of the All Progressives Congress, APC, as the winner by the Independent National Electoral Commission (INEC).
The Petition is coming barely 24 hours after Obi hinted in a press statement that he will be going to court to challenge the process which many viewed as ‘’heavily tainted.’’
The petition as seen by theG&BJournal reporter is marked CA/PEC/02m/2023 with Peter Obi, Labour Party, LP as plaintiff, while the Independent National Electoral Commission, (INEC) Bola Tinubu, and the All Progressives Congress are the defendant.
‘’The Motion Exparte,’’ the party said, ‘’is brought pursuant to Section 36(1) of the Constitution of the Federal Republic of Nigeria, 1999, Section 146 of the Electoral ACT, 2022 and paragraph 47(1)54 of the First Schedule to the Electoral Act, 2022 and under the inherent power of the Honourable tribunal.’’
Mr Obi and his running mate Datti Baba-Ahmed had out rightly disputed and condemned the results published by the INEC as well as the declaration that the 2023 Presidential Election was won by the ruling All Progressives Congress (APC) candidate, Bola Ahmed Tinubu.
‘’This will probably go down as one of the most controversial elections ever conducted in Nigeria,’’ Obi said in his press conference Thursday, while challenging the validity of the election winner. ‘’Let me reiterate and assure my good people of Nigeria that we will follow all available legal and peaceful procedures to reclaim our mandate,’’ he added.
