Biafra: Nnamdi Kanu loses appeal

The Court of Appeal, Abuja division has affirmed the decision of Justice James Tsoho, of an Abuja Federal High Court, which struck out an application by director of radio Biafra and leader of the Indigenous people of Biafra (IPOB), Nnamdi Kanu for bail. Kanu who is facing charges alongside Benjamin Madubgwu and James Nwawuisi at the Federal High Court Abuja, for allegations of treason and maintaining unlawful society among others, had approached the higher court with an application, challenging the decision of the Federal High Court.

Kanu through his lawyer, Chucks Muoma SAN, had asked the higher court to determine whether the ruling by Justice Tsoho of the Federal High Court was not an aberration of Kanu’s fundamental rights as stipulated in the constitution. The appellate court in its ruling however, held that the lower court was right in relying upon Kanu’s dual citizenship, as bases for denying his application for bail.

The three man panel, led by Justice Abdul Aboki said the chances of returning to his other country were high for Kanu and that the laws of his other country may prevent the trial from reaching its logical end.

The court also held that the charge against the defendants was grievous and involved a threat to the state, therefore an application for bail would not be entertained.

It also affirmed that the Federal High Court acted within its jurisdiction, in the said ruling, and hence affirmed the ruling of the court.
