Backlash and court orders trail Police enforcement of Tinted Glass Permit law

FRI OCT 03 2025-theGBJournal| The enforcement of the tinted glass permit regulations by the Nigeria Police Force (NPF) has been hit by a barrage of court orders, led by the Nigerian Bar Association (NBA) order.

The NBA on Friday formally notified the Nigeria Police Force of the pendency of Suit No. FHC/ABJ/CS/1821/2025 challenging the legality of the tinted permit policy.

The NBA is demanding an immediate abatement of all acts in disregard of the court and has further resolved, through NBA-SPIDEL, to proceed with contempt and disciplinary proceedings against any erring officers.

The Bar has equally admonished CSP Benjamin Hundeyin, vexed that the CSP is ”presenting the Nigeria Police Force as obstinately proceeding with the enforcement of the policy despite the pendency in court of the suit challenging the legality of same.”

The NBA made it clear that the action of CSP Hundeyin inciting the enforcement of the policy which is subjudice is an egregious act of disregard to and contempt for majesty of the court.

”The NBA will therefore not hesitate to commence contempt/committal proceeding against CSP Benjamin Hundeyin if he fails to desist from clear utterances meant to downplay the authority of the court in the public domain.”

The Officer-in-Charge of the Directorate of Legal Services AIG Ohiozoba O. Ehiede has also been advised by the NBA, to offer the proper legal guidance on this issue, which it says, must be one that guide the Nigeria Police Force to uphold the rule of law and not to tamper with the subject matter of the pending suit.

Similarly, the Federal High Court sitting in Warri has issued an order directing the Police and the Inspector General of Police (IGP) to maintain the status quo in the ongoing case concerning the controversial tinted glass permit.

The case, Suit No. FHC/WR/CS/103/2025: John Aikpokpo-Martins v. Inspector General of Police & Nigeria Police Force, came up for hearing today.

Delivering the interim order, the Court directed the police authorities to respect judicial processes pending further proceedings in the matter.

Kunle Edun, SAN, who led the legal team, noted that the directive is a major step in ensuring that the rule of law is upheld while the substantive issues in the case are being determined.

Meanwhile, several Nigerian’s the G&BJournal spoke to expressed dismay at the law, with many arguing that the tinted glass enforcement should be prioritized by the Police over a more strategy approach to fighting crime and insecurity that plagues the country.
